General

1.1 These terms and conditions (“T&C”) apply to your use of the Games (as described below), as well as any associated internet, mobile, or other platforms, through the website www.9winz.com (“Website”) and any linked URLs owned by or licensed to 9winz.

1.2 These Terms and Conditions and the laws of Curacao regulate the legal agreement between the registered player and 9winz.

1.3 As soon as you click the “Open Account” button, these T&C take effect. You confirm to 9winz that you have read, comprehended, and accepted these T&C by creating, opening, or registering an account with 9winz. You agree to these T&C and pledge to uphold them at all times when using the 9winz website and games by using the website or any of the games.

1.4 Prior to pressing the “Submit” button, you must read these T&Cs completely. You must not use or keep using the Website if You disagree with any term of these T&C.

1.5 You acknowledge that you have read, understand, and agree to be bound by the terms and conditions set out in this document, including any updates.

1.6 9winz maintains the right to alter these T&Cs at any moment, which also entails altering the terms of the contract that exists between You and 9winz.

1.7 Any such modifications will be disclosed to you in advance, and they will take effect as soon as you agree to the T&Cs on www.9winz.com. You have the right to refuse to accept the modified T&Cs, but if you do, you won’t be able to use 9winz’s services any more. Nevertheless, you will have the option to withdraw all funds from your account and request that it be closed via customer service.

1.8 Information about how to play any of 9winz’s games, how to keep your account active, and other crucial details are available via separate links on the website and are incorporated into these terms and conditions by reference.

1.9 In these T&C, any mention of 9winz’s games includes casino, live casino, and any additional games that may occasionally become accessible on the website. 9winz maintains the right, at its sole discretion, to add and remove Games from the Website.

1.10 For informational purposes and convenience of reference, these T&C are available in a variety of languages. The connection between You and 9winz is only legally based on the English version of these T&C, and in the event of a conflict between the English version and any non-English version, the English version shall take precedence.

1.11 9winz reserves the right to block or close any or all of Your accounts if you open or attempt to open more than one account for any reason. Additionally, 9winz retains the right, in its sole discretion, to withhold any deposits or winnings upon the discovery of duplicate or multiple accounts. If 9winz chooses to keep one account active, Your remaining deposits, if any, will be moved to the first account that You registered with 9winz. For each account You open with 9winz, an administrative fee of 20% (minimum 7,500 INR or $100 USD) will be deducted, in addition to any additional deductions that might be necessary under these T&C.

Additionally, any money kept in your additional account(s) will be instantly forfeited, and no winnings will ever be paid out, if you try to open one after your primary account has been terminated due to gambling addiction.

1.12 To the extent permitted by law, 9winz maintains the right to retain all information you supply as personal data. You have the right to look up any personal information we may hold about you.

1.13 If a promotion’s reward cannot be awarded because of unavoidable circumstances, 9winz reserves the right to substitute a different prize. 9winz will make sure the customer is given at least the same, if not better, position in this situation.

The User Account

2.1 Signing up and starting your member account

2.1.1 You must first register with 9winz, create an account (a “Member Account”), and deposit funds into your Member Account in accordance with the instructions on the next page in order to take part in any of 9winz’s games for real money.

2.1.2. An applicant for account holder status further warrants and represents:

a. must be a living individual (a legal entity is not acceptable as an account holder);

b. not to be a citizen of Afghanistan, Aruba, Australia, Curacao, Denmark, Estonia, Ethiopia, France and other French territories, Hong Kong, Iran, Iraq, Italy, Jordan, Kuwait, Netherlands, North Korea, Pakistan, Philippines, Saba, Statia, St. Martin, Spain, Syria, Turkey, United States of America and other U.S. territories, United Kingdom, or Yemen;

2.1.3 9winz is entitled to designate payment solution providers to act, receive, and/or disburse money on its behalf.

2.1.4 On this website, you are only permitted to have one member account. All accounts you seek to open may be blocked or closed if you try to open more than one Member Account (following such efforts, the initial account established may be blocked for review by the security department).

2.1.5 You must contact 9winz right away if you discover that you have more than one Member Account using various identities.

2.1.6 By completing the registration form and submitting it to 9winz online, a request to open a Member Account is made. For whatever reason, 9winz maintains the right to refuse to open a Member Account.

2.1.7 You must fill out all required fields on the registration form, including those relating to your age, identity, address, and contact information (including, if applicable, a valid mobile phone number and email address), place of residence, place from which you intend to access the website, and relevant payment information, all of which must be true and accurate. It should be noted that in order to engage in the games offered on the Website, you must be 18 years of age or older, or the higher minimum legal age specified in the laws of your jurisdiction that apply to you. It is entirely Your responsibility to make sure the information You supply is accurate, complete, and up-to-date, and by providing this information to 9winz, You hereby represent and warrant that it is.

You are now informed that 9winz performs customer deposit verification processes, either internally or through outside parties. In order to complete the 9winz KYC procedures, you may be asked to submit papers, such as a copy of your passport or other forms of identity, at any time, including the deposit stage, withdrawal stage, or both. Additionally, 9winz has the right to request any previous KYC documentation that has since expired or has become invalid for any reason, as well as any additional KYC documentation, for any cause and at any time. If you fail to supply the specified information or documents or if it is determined that the information or documents you do give are incorrect or misleading, your Member Account may be suspended or terminated. Until the 9winz verification process is finished, 9winz reserves the right to cancel Your Member Account and withhold any cash held in Your Member Account. If 9winz’s verification processes reveal that you are underage:

1. 9winz will reimburse any deposits made by You and will not pay out winnings;
2. Insofar as is reasonably possible, all transactions made by you while you were underage will be void, and all associated monies placed by You will be repaid via the payment method used to deposit such amounts; and
3.  The closure of your Member Account.

2.1.8 You must select a username and password for your website login as part of the registration procedure. You are entirely responsible for ensuring the security of Your login information. Your login information must not be shared with anybody. If you accidentally or intentionally reveal your login information to a third party, whether actively or passively, 9winz is not liable for any misuse or abuse of your member account on their behalf. Additionally, 9winz retains the right to suspend or close the account and retain any funds in its sole discretion if it discovers or suspects that someone other than You is using the player account.

2.1.9 You are not permitted to sell, transfer, or buy accounts from or to other players, nor are you permitted to send money from your Member Account to other users or receive money from other users into your Member Account.

2.1.10 9winz has the right to refuse to open an account or close an existing account at its discretion and without having to give a reason. However, all previously agreed-upon contractual responsibilities will be upheld.

2.1.11 If you haven’t viewed your account in the last 12 months and it still has actual money in it, it will be deemed inactive. Before your account is set to become inactive, 9winz will email you to give you at least thirty (30) days’ notice. In such a situation, you will have the choice to withdraw your money, subject to any withdrawal policies outlined above and in any relevant laws and regulations. If your account becomes inactive, 9winz has the option to close it or charge you a fee for inactivity. Only inactive accounts that don’t have a negative balance can have fees applied to them. If 9winz chooses to impose an inactivity fee, it will be a monthly administrative cost equal to 10% of the balance, or the equivalent in any other currency, with a minimum of 100 INR. Before beginning to collect a fee from you, 9winz must email you a notice at least thirty (30) days in advance. Without regard to any AML regulations, if 9winz decides to deactivate your account, we will make every effort to return your remaining amount by either sending the money to you directly or getting in touch with you using the information we have on you. We will either (i) leave the account open or (ii) cancel the account and take the remaining balance if we are unable to send the remaining balance. The following requirements must be met when the balance is allotted for acquisitive prescription to apply in favor of 9winz:- (a) If you don’t provide a way for the funds to be remitted, 9winz will send you a final notice informing you that the funds will be appropriated; (b) This notice will be sent to you via any and all channels 9winz has available to it, including by mail; (c) Five (5) years after the final notification was delivered to you, 9winz may prescribe the remaining monies in its favor; Any player funds that 9winz appropriates must go toward projects that promote responsible gaming.

2.1.12 All transactions will be examined by our fraud personnel in line with any applicable rules and regulations pertaining to the prevention of money laundering.

Any suspicious activity on Your account could result in a notification to the appropriate authorities and the freeze of Your cash. Additionally, it can result in the closure of Your account and the seizure of Your money.

Your User Responsibilities

3.1 You pledge and guarantee the following:

3.1.1 You are able to participate in the games on the Website under the laws that are relevant to you, and you are at least 18 years old or the minimum legal age required by your country.

3.1.2 You are fully aware that it is wholly and only your obligation to confirm and verify that your participation in the Games does not violate any laws that are relevant to You;

3.1.3 You will only use the Website and your Member Account to play the Games; you will not use them for any other purpose, whether financial or otherwise; you will play the Games strictly for fun and entertainment in your own personal, non-professional capacity;

3.1.4 You register on your own behalf, and you do not represent anybody else when you engage in the games.

3.1.6 That during the course of this Agreement, any information you give to 9winz is accurate, complete, and current, and that you will tell 9winz right away if any of that information changes;

3.1.7 Any taxes owed by you in connection with your participation in games, including any winnings from 9winz, must be reported and accounted for by you alone.

3.1.8 No funds you put into your member account are tainted by unlawful behavior or sources, and none of the funds you deposit are either.

3.1.9 You are aware that playing the games exposes you to the possibility of losing funds placed in Your Member Account;

3.1.10 You are not and will not engage in any fraudulent, collusive, fixing, or other illegal activity in connection with your participation in any of the games or that of third parties. You also will not make use of any hardware devices or software-assisted methods or techniques in connection with your participation in any of the games. In the event of such behavior, 9winz hereby reserves the right to invalidate or close Your Member Account or invalidate or terminate Your participation in a Game;

3.1.11 You must only use monies, credit cards, and other financial instruments that are legitimate and legally yours when making deposits into and withdrawals from Your Member Account.

3.1.12 The computer software we provide to You is owned by 9winz or other third parties and is shielded from infringement by copyright laws and other intellectual property rights. The software may only be used by You for Your own private, noncommercial use in compliance with all provisions of these T&C and all relevant laws, rules, and regulations.

3.1.13 Playing games on or through the Website should follow the same rules as playing games anywhere else. You must be polite to other users and 9winz employees and refrain from making offensive comments, even in chat rooms.
